Recently, partner and Wichita medical malpractice attorney, Ryan A. Prochaska, was featured in the Kansas Reflector, a nonprofit news operation covering state government and politics, discussing the increased difficulties of bringing cases to trial due to the lack of judicial branch funding and the effects of COVID-19. This, in turn, has created a backlog of cases without trial dates, encouraging lawmakers to plea for $24.5 million in judicial raises and 70 additional court service officers.

Prochaska declares that without a trial date, defendants and their insurance carriers either refused to resolve cases or advanced low-ball offers to see how desperate a plaintiff was for some quick cash rather than continuing to wait for a trial date. Prochaska has seen the effects of the pandemic first-hand with his client in Pratt County, working since October of 2019 to bring to trial a lawsuit filed on behalf of a child after experiencing a traumatic brain injury. Due to Pratt County’s lack of resources to conduct safe trials during the global pandemic, his brain-damaged client was ultimately left without any form of timely justice.

“This delay solely harms my client and solely benefits the insurance company who continually gets to hold on to their money,” said Prochaska. “I am hopeful that for the sake of the citizens of Kansas, the Legislature will adequately fund our courts so we can get back to providing timely justice to all parties.”
