Expert Witnesses

FAQ: What is “Expert Testimony”?

Are you or a loved one considering or currently pursuing a medical malpractice case due to a bad medical outcome? If so, an important aspect of the case will involve “expert testimony,” which is insight from someone who specializes in and is highly qualified in the area of medicine that’s at the center of the case. However, it’s important to note that most of the time, expert testimony will be provided by a neutral party.

According to medical malpractice attorney, James R. Howell of PHP Law Firm in Wichita, Kansas, “Many times, they aren’t people who were there and saw what happened or were involved in the care.”

Instead, expert testimony is often provided by someone who is hired and retained during the course of the medical malpractice case to look at the facts, testimony and medical records. They then apply their education, training and experience to the case in order to determine if the “standard of care” was provided.

When the Standard of Care is Not Provided

The standard of care is based on the rigorous education and training health care providers receive. Through such education and training, health care providers develop a basis from which they determine how to treat various signs, symptoms and patient histories. Simply put, the standard of care is what a reasonable health care provider would do given the same or a similar situation.

If your health care provider or the provider of your loved one failed to deliver the standard of care and it resulted in harm, injury or even death, medical malpractice may have occurred. We recommend that you discuss your situation with the PHP Law Firm team as soon as possible.
